Additional information: Our client was President of the Regional State of an African country. A group of people had created a fake Facebook Page that gave the impression that it belongs to the President. The fraudulent Facebook Page was using images of the President and was being used to make personal and political comments in relation to the President and the Region which were falsely attributed to the President. The genuine Facebook Page states that it was an Official Government Page whereas the fraudulent Facebook Page only claimed to be a “Community Page”. Whilst the official President Facebook Page had over 300,000 followers, the fraudulent Page had approximately 17,000. Nonetheless, both the President and Government were concerned that the fraudulent Facebook Page was provoking national unrest by spreading fake news. They were concerned that the fake Facebook Page was gathering momentum fast. Our expert social media lawyers used an existing contact with Facebook to quickly explain the complex situation. Facebook agreed to delete the fake Facebook Page whilst our client agreed to not persist with his disclosure order application aiming to disclosure the identity of the people behind the fake Facebook Page.

Our client complained about news articles which related to a criminal prosecution in 2000 which resulted in the applicant being found not guilty. The main witness in his case had admitted in court that she had been lying in her evidence.
The new paper articles described the main witness’ evidence at court, evidence which turned out to be false. The article created a false impression that our client was a sexual predator. Our solicitors made a successful application to Google to remove links to the news article on the basis that the data contained about our client in the news articles was inaccurate and had a disproportionately negative impact on our client, breaching his right to be considered innocent, and his right to private life. Our client was convicted in 2009 for a serious public order offence, involving a touching another person in a manner which the victim considered sexual.
He received a community punishment order and was placed on the sex offenders register for a period of 3 years. In 2018, with his conviction considered as spent, he had made an application to Google to remove a news articles which appeared on the DailyRecord.com. Google refused, citing the serious nature of the offence. Our right to be forgotten lawyers prepared a second right to be forgotten to Google.
Swiftly, Google agreed to the de-listing of the news articles which related to the previous conviction. However, despite this, it appeared that Google online de-listed two out of three news articles. The most serious one remained accessible through Google search.
After further discussions with Google, Google de-listed all the news articles from Google.co.uk, but only from the English version. It took further communications between our right to be forgotten lawyers and Google before Google completely de-listed the entire list of news articles concerning our client’s previous conviction.

Additional information: Our client was a politician who had a fake Facebook Page created to his name. The fake Facebook Page was visually similar to the Facebook Page of our client and included images of our client. Whoever created the similar fake Facebook Page had given the initial impression that the Facebook Page belonged to our politician client. The fake Page which also contained images of our client was used to attack our client personally with personal and political comments which were wrongly attributed to our client. First, our client’s office wrote to Facebook asking to remove the fake Facebook Page but Facebook declined the request, claiming that there was public interest in retaining the Page. Our social media lawyers communicated with Facebook to reject Facebook reasons for refusing to delete the fake Facebook Page. They rely on an established legal principle that there is never public interest in fake information. They also asserted the our client’s privacy rights, the rights of Facebook users to be presented with content which isn’t highly manipulated, Facebook own terms of business and other legal rights, including intellectual property rights. Facebook then permanently deleted the fake Facebook Page.

Additional information: In this project our internet and social media lawyers represented a global gold mining company that became to subject of defamation by a disgruntled shareholder who posted false allegations about the company and its chairman. Initially the PLC responded to the defamatory allegations on the forum but very quickly its board felt that this was only increasing the visibility of the defamation on search results. Some shareholders who viewed the poisonous forum comments started to sell their shares, which became almost worthless. Following our social media solicitor's intervention the posts were removed and the culprit was force to issue an apology. At the same time, our lawyers cleared the internet of dozens of other defamatory posts from other investors forums. The company's shares recovered almost immediately after.
